Operator: 2835524 Ontario Inc. d/b/a “PetChip” (“PetChip”, “we”, “us”, “our”)

These Terms of Service (“Terms”) are a legal agreement between PetChip and any person or entity that creates an account, registers a microchip, uses our Chip Lookup, receives alerts, or otherwise uses petchip.ca and related services (collectively, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy (together, the “Agreement”). If you do not agree, do not use the Services.

1) What PetChip does

PetChip provides a pet microchip registration and recovery service that lets pet owners store contact and ownership information linked to a microchip ID, and enables alerts when a chip is looked up. We may share “lost pet” status and limited contact data with participating shelters, clinics, and partner databases to help reunite pets and families.

PetChip is not a government registry, veterinary practice, insurer, law‑enforcement agency, or emergency service. We cannot guarantee that every scanner, database, shelter, clinic, or finder will access or honor your record, or that a lost pet will be found.

2) Eligibility & accounts

• You must be 18+ and capable of entering a contract.
• You are responsible for keeping your login secure and for all activity on your account.
• Provide accurate information and keep it up to date (owner name, phone, email, address, emergency contact). Inaccurate data may prevent reunification.

3) Services & features

3.1 Registration

You may register a 15‑digit ISO microchip and link it to your pet’s profile. Some chips may require manual validation or batch activation. We recommend registering within 24 hours of implanting or purchase.

3.2 Lost pet tools & alerts

When you mark a pet as Lost, we flag the chip in our system and participating partners. When a finder looks up the chip through PetChip, we send Instant Finder Alerts (SMS/email) to your contact(s) and may display limited contact details to the finder so you can connect.

Message/SMS terms: message and data rates may apply; frequency varies. Reply STOP to opt out of SMS; you may still receive essential account emails.

3.3 Chip lookup (finder use)

Finders agree to use contact details solely to reunite the pet and not for harassment, marketing, or any unlawful purpose. We may log lookup events for fraud prevention and audit.

3.4 Partner visibility

We may submit or expose limited registration data to industry search partners to improve reunions. Compatibility varies by chip model, scanner, jurisdiction and partner systems; we cannot guarantee universal visibility.

4) Plans, fees & billing

• Some features require a paid plan. Prices are shown at checkout in CAD unless stated otherwise.
• Auto‑renewal: subscriptions renew automatically each billing period (monthly or annually) until canceled.
• Cancel anytime: You may cancel through your account portal or by emailing info@petchip.ca. Cancellation takes effect at the end of the current paid period.
• Refunds: Except where required by law, fees are non‑refundable once a period begins (no refunds for partial months). For annual prepay plans, you can cancel any time; the plan remains active until the end of the prepaid term.
• Price/feature changes: We may update plan pricing or features with notice before your next renewal.
• Statutory rights: Nothing here limits any rights you have under applicable consumer protection laws (including Ontario’s Consumer Protection Act).

5) Optional physical items & third‑party offers

We may offer optional physical items such as ID tags. Shipping times are estimates, not guarantees. Third‑party offers (e.g., pet insurance promotions) are governed by the partner’s terms; PetChip does not sell insurance.

5.1 Complimentary Vaccine Benefit (subscription bonus)

For eligible pets with an active PetChip subscription, PetChip will provide one of the following at no additional charge: (a) a puppy’s second core booster (DHPP/DA2PP) at approximately 12 weeks of age (the second dose in the initial puppy series after the first dose), or (b) one regular annual core booster for an adult dog during the covered year.

This benefit is redeemable **only at PetChip partner veterinary clinics** and requires a PetChip referral (digital voucher or code) issued to the subscriber prior to the appointment. Redemption at non‑partner clinics is not permitted and will not be reimbursed.

The vaccine must be administered by a licensed veterinarian at a participating clinic. The benefit is limited to one vaccine dose per pet per subscription year and excludes examination fees, additional services, non‑core vaccines (e.g., Bordetella, Leptospirosis, Lyme; Rabies unless designated as the clinic’s core booster), deworming, titers, medications, and any care related to adverse reactions. Appointment availability and clinical judgment (including timing and suitability) are at the discretion of the attending veterinarian.

Pet eligibility requires that the pet is registered to the subscriber’s account with a verified microchip, and the subscription is active and in good standing on the service date. The benefit has no cash value, is non‑transferable, and may not be combined with other promotions unless expressly stated. Geographic availability depends on partner clinics and may change.

PetChip may modify or discontinue this benefit on a prospective basis. Any issued referral or voucher remains valid through its stated expiry.

6) Breeder / seller warranty add‑on (if shown)

Where advertised with your purchase, a 1‑year genetic health warranty is provided by the seller identified on your receipt (not by PetChip, unless PetChip is named as the seller). The warranty generally provides a refund limited to the puppy’s purchase price if a covered genetic condition is diagnosed by a licensed veterinarian within 12 months of purchase and all required records are submitted. Veterinary, care, travel, incidental or consequential costs are not covered. See the specific warranty document presented at purchase for the full terms, process, and exclusions. This warranty is not insurance.

7) Acceptable use

• You agree not to misuse the Services, attempt to access others’ data, reverse engineer, or interfere with security;
• You agree not to submit unlawful, defamatory, obscene, or infringing content;
• You agree not to use lookup results for any purpose other than reunification;
• You agree not to harvest or sell user data;
• You agree not to misrepresent ownership or authorization regarding a pet or chip.

We may suspend or terminate access for violations.

8) Your content & license

You retain ownership of content you upload (pet photos, descriptions, notes). You grant PetChip a worldwide, non‑exclusive, royalty‑free license to host, use, display, and share that content solely to operate and improve the Services and facilitate reunification. You represent that you have all rights to the content you provide.

9) Privacy

Our use of personal information is described in our Privacy Policy. By using the Services, you consent to processing in accordance with that policy, including sharing limited contact information with finders, shelters, clinics, and partners to aid reunification. We share necessary contact information with shelters, clinics, recovery services, and finders to reunite lost pets. Do not include sensitive data you do not wish to share.

10) Service availability & changes

We may modify, suspend, or discontinue features at any time with or without notice. We strive for high availability but the Services may be unavailable due to maintenance, outages, partner downtime, or factors beyond our control.

11) Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non‑infringement, accuracy, or uninterrupted availability. We do not guarantee that a pet will be found, that a finder will contact you, or that any particular database or scanner will access your record. The Services are not medical or legal advice and are not emergency services. In emergencies, contact local authorities, animal control, a veterinarian, or a shelter.

12) Limitation of liability

To the maximum extent permitted by law, PetChip and its owners, directors, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, data loss, or business interruption, even if advised of the possibility. Our total liability for any claim related to the Services is limited to the amount you paid to PetChip in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations; where prohibited, the limits apply to the fullest extent permitted.

13) Indemnity

You agree to defend, indemnify, and hold harmless PetChip from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your content, your misuse of the Services, violations of the Agreement, or your interactions with finders/owners.

14) Payments; chargebacks

You authorize us and our payment processor (e.g., Shopify/Stripe) to charge your payment method for fees and auto‑renewals. We provide a simple online cancellation method consistent with card‑network rules. Chargebacks used to circumvent the published cancellation method may result in suspension.

15) Intellectual property

The Site, Services, and all associated content, trademarks and logos (including PetChip and associated marks) are owned by PetChip or its licensors and are protected by law. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works.

16) Third‑party links & partners

The Services may link to third‑party sites or services. We do not control or endorse them and are not responsible for their content, terms, or privacy practices.

17) Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on the Site and/or emailed to the address on your account. Continued use after changes means you accept the updated Terms.

18) Governing law; venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict‑of‑laws rules. You agree to the exclusive jurisdiction of the courts of Ontario (sitting in [Toronto]) for any dispute that is not subject to arbitration (if arbitration is later added).

20) Entire agreement

This Agreement is the entire agreement between you and PetChip regarding the Services and supersedes prior understandings. If any provision is found unenforceable, the remainder will remain in effect. No waiver is effective unless in writing.

Optional: Fixed‑Term Plan (5‑year) – consumer‑friendly version

You may choose a 5‑year fixed‑term “Registration Bundle” that is prepaid and does not auto‑renew. You can cancel early, but no refunds are issued for any unused portion of the 5‑year term, except where required by law. Regular monthly plans remain cancel‑anytime.
